Court: Residency In Marijuana Legal State Not Justification For Police Search

A federal appeals court on Tuesday said police officers cannot stop and search vehicles belonging to out-of-state motorists simply because of where they reside, including states where marijuana use is legal.

By a 2-1 vote, the 10th U.S. Circuit Court of Appeals in Denver said two Kansas Highway Patrol officers violated the constitutional rights of Colorado motorist Peter Vasquez in December 2011 by pulling him over and searching his car after he had been driving alone at night on Interstate 70.

The officers relied heavily on Vasquez’s residency to justify the search, which uncovered nothing illegal, saying Colorado was a known “drug source” where marijuana is legal.

But the court said that would justify searching motorists from the 25 U.S. states that permit marijuana use for medical purposes, and the four states, including Colorado, plus Washington, D.C., where recreational use is allowed.

“It is time to abandon the pretense that state citizenship is a permissible basis upon which to justify the detention and search of out-of-state motorists, and time to stop the practice of detention of motorists for nothing more than an out-of-state license plate,” Circuit Judge Carlos Lucero wrote.

“Absent a demonstrated extraordinary circumstance, the continued use of state residency as a justification for the fact of or continuation of a stop is impermissible,” he added.

The decision revived Vasquez’s civil lawsuit seeking damages from officers Richard Jimerson and Dax Lewis for violating his Fourth Amendment right against unreasonable searches. A lower court judge had dismissed the case in November 2014.

Chief Judge Timothy Tymkovich dissented, saying the case was a “close call” but that reasonable officers might have thought Vasquez’s travel plans suspicious and the search acceptable.

Jennifer Rapp, a spokeswoman for Kansas Attorney General Derek Schmidt, said he intends to ask the entire appeals court to review the panel’s decision.

Vasquez, now 37, said in a telephone interview that the decision shows that “police officers shouldn’t be able to do whatever they want” because they wear badges.

“I’m ecstatic,” said Vasquez, who now lives in San Antonio.

The 10th Circuit decision applies in Colorado, Kansas, New Mexico, Oklahoma, Utah and Wyoming.

The case is Vasquez v Lewis et al, 10th U.S. Circuit Court of Appeals, No. 14-3278.

Although I’ve been home from Bali several weeks, I keep dreaming I’m there…the sounds, the smells, images of the people wash over me:

  • The beauty of this island full of flowers and smiling faces.
  • The gamelan music, an orchestra of percussion instruments, bells and bamboo flutes that mimic the sounds of a Bali morning – insects, birds, roosters, ocean waves.
  • The scent of incense lingering from the daily offerings of carefully crafted coconut or palm frond containers full of colorful flowers, offered to appease the lower gods and honor the higher gods.
  • The chaos of cars, trucks and motorbikes carrying whole families and goods to market passing within inches on narrow roads – made safe by the gentle toot or toot-toot that signals passing.

Immersed in the Balinese culture for two weeks, I was reminded there are so many good ways to live. We visited my friend Susan, a psychologist, who lives in Bali. There is no work for her among the locals. They are too happy. Traveling with my daughter Lisa, we mused about what keeps the people contented. Lisa wrote about it in her blog: What the Balinese do for Anxiety.

As part of their Hindu Buddhist religion, as Lisa describes, everyone prepares and dedicates offerings to the gods. Every day. In every home, store and village. Before picking us up, our drivers prayed in their family temples for our safe trips. Children learn very young to play in a gamelan orchestra, and to dance the traditional Balinese dances. The dancing is complex, physically difficult, using every body part including head and eyes, in still and flowing patterns to the sound of the gamelan, each movement carrying meaning. The dances act out familiar stories that are sometimes funny, always teaching moral lessons. Characters include the gods of good and mischief and evil. Beautifully carved sacred masks and elaborate costumes are integral to the dances.

We saw several Balinese dance performances, and one night we were treated to another traditional form of theater – a shadow puppet show. Behind the screen, which we were invited to visit, was an entire family supporting the puppeteer. He told a piece of the traditional Ramayana story – an ancient, epic Hindu story. However, he improvised the telling for the audience (our small group of Americans.) He made it modern and relevant to us, including references to surprising things like Pokemon Go!

Steeped in tradition, ritual and shared beliefs, the Balinese are warm, relaxed and friendly. Good humor abounds. They seem untroubled by questions like, “Who am I?” “Where do I belong?” and “How can I feel safe?” Those questions are answered in the context of their daily lives, living with family, belonging to compound and village, doing the daily rituals, sharing in the many large ceremonies and celebrations.

Bali is an open-hearted culture. Thinking of it makes me happy. I hope my Bali dreams continue.

Since coming home, I’ve been asking myself questions: how might we build ritual and tradition more solidly into our daily lives? How open-hearted is the United States? And – what might be an American equivalent to the gentle, respectful horn toots on the highways that keep people calm, safe and cared for?

Is TMJ Disorder Costing You A Good Night’s Sleep?

If you are one of the estimated 40 million+ Americans who suffer each year from chronic sleep disorders or one of the additional 20 million who experience occasional sleeping problems, you know first hand how the problem can affect your quality of life. A sleep disorder can interfere with your work, your ability to drive and your participation in social activities.

Did you know that many patients who suffer from sleep disorders are also dealing with a problem directly related to disorders in their temporomandibular joint (TMJ)? The TMJ is the joint that attaches your lower jaw, or mandible, to the temporal bone of your head. More precisely, it is where the lower jaw fits into the skull and is supported by the muscles in your face. It is the joint that allows you to chew, swallow and yawn. However, when it isn’t functioning properly it can be the root of a lot of problems.

A disorder in this important joint can cause pain and discomfort in other parts of the body and these TMJ disorder symptoms — including sleep apnea, teeth grinding and tension headaches or migraines — can impact your ability to get a good night’s sleep.

Experts estimate that more than 44 million Americans have one of the several variants of TMJ disorder, or TMD, with women more prone to the condition than men. Pain when chewing is a common symptom, as are other warning signs including limited movement of the jaw or a locking sensation, ringing in the ears, jaw clicking and grating or popping of the jaw joint. These symptoms are often a result of muscle tension and misalignment in the jaw. Although minor symptoms may be relieved with a little rest, hot and cold packs, a soft diet, TMJ massage and/or jaw exercises, persistent symptoms can lead to chronic problems that disrupt your sleep and can become more difficult to treat.

Sleep Apnea

We have all seen the images of tools used to manage sleep apnea that require sufferers to sleep with a CPAP mask, making them look like a super villain or scuba diver. However, obstructive sleep apnea is a potentially serious condition. Sufferers experience obstructed airflow and stop breathing repeatedly during sleep, sometimes for a minute or even longer. This may happen from five times an hour to more than 100 in severe cases. The body is damaged by only 5 of these episodes an hour, and as we learn more, it appears that even minor episodes can cause chronic damage.

When breathing stops, the brain reacts to the situation by producing a rush of adrenalin which in turn quickens the heartbeat. Muscles in the chest then work to resume airflow and the person gasps for a breath and falls back asleep. This scenario is then repeated multiple times during the same night while the person never realizes what is occurring. That’s because they never really “wake up” but only experience a short pause in sleep. This pause destroys the normal sleep cycle cascade which is critically important to health and brain function.

More and more studies are showing a connection between TMD and sleep disturbances. In many sleep apnea cases, a misaligned jaw joint or TMJD, is actually to blame. This is because the tongue’s position is impacted by the alignment of the upper and lower teeth. When the teeth are misaligned, the tongue can block the airway as you sleep. This problem with the jaw alignment or malocclusion can cause a person to wake up frequently throughout the night.

Untreated sleep apnea causes snoring and can lead to much more serious health issues such as high blood pressure and heart disease. In addition, people with sleep apnea do not get the rest they need because, as a preventative reaction, their brains keep them from falling into a deep sleep mode.

Bruxism

Another symptom of TMD is bruxism, commonly called teeth grinding. A misalignment of the jaw can cause you to unconsciously grind or clench your teeth together.

Bruxism causes significant damage to your teeth and is something that is easily corrected with proper physiologic care. You would be surprised at how forcefully we can clench our teeth. As we are waking, the pressure when clamping the teeth together can reach about 200 pounds per square inch. However, when we are asleep, that force can reach more than 700 pounds per square inch!

Because of this force, people with severe bruxism can break their dental fillings and/or cause the outer layers of their tooth enamel to wear away, exposing the highly sensitive dentin. Additionally, this extreme jaw muscle tension can result in complications that include other TMJ disorder symptoms like lockjaw and tension headaches.

Night Headaches

When the bite and the lower jaw are misaligned, muscles are strained which can result in head pain that can mimic a migraine. This pain can be around the forehead, on the back of the head or radiating down the neck.

The same obstructive breathing that causes sleep apnea also can cause nighttime or hypertensive headaches. To put it simply, lack of oxygen can trigger a painful headache.

Many people turn to over-the-counter pain medication for headaches rather than exploring the root cause of the pain. Common signs that a headache is related to a TMJ disorder include:

● A clicking or popping sound emanating from the jaw
● A bite that feels off or does not close properly
● Complaints of snoring at night from your spouse or family
● Forward head posture

Researchers from the University at Buffalo School of Dental Medicine found that headaches related to TMJ dysfunction are frequently misdiagnosed as tension headaches. In a study of 583 patients with frequent headaches, 82 percent of female cases and 17 percent of male cases had symptoms associated with TMD.

Finding Relief

If you think TMD could be causing your sleep problems, here are some tips you can try at home:

● Gently stretch your neck throughout the day
● Improve your posture
● Avoid chewing gum
● Gently massage your jaw muscles
● Commit to a soft diet
● Try to use other home remedies to lessen the severity of a TMD flare up
● Learn to combat stress with exercise or meditation. (Stress can exacerbate pain.)
● Move the jaw gently from side to side 10 times and then allow it to rest for a minute. Do this for 5 sets a few times a day. This will help to stretch the muscles of mastication.

Although the exercises above may help, if the system is not physiologically correct, the best advice is to get it corrected. The headaches can start as a nuisance but can eventually become incapacitating.

In my experience as a educator for TMJ dentists and clinical director at LVI Global, up to 85% of TMJ disorder symptoms can be resolved without prescription drugs or surgery. Instead, we return the jaw muscles to their natural place of physiologic rest which allows the system to function correctly. Treatment through neuromuscular dentistry strives to reduce or resolve symptoms by focusing on fixing the muscles that support the bite. The result is a dramatic lessening of muscle pain and in many cases, a better night’s sleep.

Melania Trump Threatens Lawsuit Against Daily Mail Over ‘False And Defamatory’ Escort Claims

A lawyer representing Melania Trump, the wife of Republican nominee Donald Trump, said Monday that a recent Daily Mail report included “false and defamatory statements” that she worked for an escort service two decades ago.

“Mrs. Trump has placed several news organizations on notice of her legal claims against them, including Daily Mail among others, for making false and defamatory statements about her supposedly having been an ‘escort’ in the 1990s,” attorney Charles Harder said in a statement.

“All such statements are 100% false, highly damaging to her reputation, and personally hurtful,” Harder continued. “She understands that news media have certain leeway in a presidential campaign, but outright lying about her in this way exceeds all bounds of appropriate news reporting and human decency.”

The Daily Mail, a British newspaper with a massive global online presence, published an article Friday examining whether Melania Trump began working a model in the United States in 1996, as she’s claimed, or in 1995, the year which recently published nude photographs were taken. The emergence of the photographs has raised questions about her biography and about her immigration status when she began working in the U.S.

Donald Trump, who has railed against undocumented immigrants throughout his campaign, said on Aug. 9 that his wife would hold a news conference “over the next couple of weeks” to address her compliance with immigration laws. No news conference has been scheduled. 

The Daily Mail report also included recent claims in Slovenian magazine Suzy that Paolo Zampolli, who ran the modeling agency that employed Melania Trump early in her career, also ran a high-end escort service.

Zampolli denied the allegations as “f****** rubbish” to the Daily Mail. (Zampolli is known for playing a role in Melania Trump’s earlier career, telling this reporter that he brought her to the U.S. as a young model in 1996.) 

Melania Trump, a Slovenia native, married Donald Trump in 2005. She isn’t nearly as prolific on Twitter as her husband, but tweeted apologies Monday by other sites that aired the rumors. 

A Daily Mail spokesperson did not immediately respond to a request for comment.

Harder has been in the headlines lately for another high-profile legal fight with a media company. He represented wrestler Terry Bollea (aka Hulk Hogan) in his $ 140 million invasion-of-privacy case against Gawker Media, a lawsuit funded by Silicon Valley billionaire Peter Thiel that effectively killed the site Gawker.com on Monday.

What No One Told Me About Following My Passion

Like much of my generation in America, I don’t have to worry about where my next meal will come from. I don’t have to worry about how I’ll get to work. I don’t have to worry about a safe, dry place to sleep.

So I worry about something else, with which much less of the world has the luxury of preoccupation: purpose. Some spend their days searching for food; I spend my life hunting meaning–full, but unsatisfied.

Most millennials’ basic needs have been met–a prerequisite for fulfilling our greatest potential. If we don’t make our lives meaningful, we will have dishonored and squandered our opportunity. Perhaps this responsibility explains our fixation with purpose.

We know what we want. The question is: how do we find it?

Hoping that international travel and novel experiences would infuse my life with meaning, I moved to Canada when I graduated college. There I learned, as I conclude in my essay The Myth of Wanderlust, “you can’t drive to purpose.”

So I returned home and pursued my lifelong passion of writing. For the last two years, I’ve followed a self-authored, step-by-step plan to successfully discovering, integrating and making money from my passions. A marketing position, an editing role and six months of self-employment later, I realized you can’t write to purpose, either.

Passion, I’ve learned, does not equal purpose.

Why?

Here’s a synopsis of the 8000 words I initially spewed on this question:

Passion, the way many millennials have come to define it, is self-oriented. Passion is “a strong inclination toward a self-defining activity that one loves, values, and in which one invests a substantial amount of time and energy,” explains one study published in Self and Identity.

Purpose, on the other hand, is other-oriented. One Stanford study found that individuals with meaning mindsets “seek connections, give to others, and orient themselves to a larger purpose.”

Modern passion is pleasure-oriented. One influential study on passion defines it as “an autonomous internalization that leads individuals to choose to engage in the activity that they like.” In other words, passion’s answer to “Why are you doing this?” is “Because I like it.”

But meaningfulness, sums the Stanford study, sometimes involves “feeling bad”.

Passion is short-term. Though we tend to assume it’s lifelong, passion changes more than we anticipate because we change more than we anticipate. As Terri Trespicio observes in her TEDx Talk, “Passion is not a plan. Passion is a feeling, and feelings change.”

Purpose is hardy. Gritty individuals, explains one study, prioritize long-term goals. This long-term perspective, another study notes, helps give “more weight to meaning than pleasure” and solidifies self-control.

I don’t regret following my passion. In fact, I still endorse my strategy. Passions help us understand who we are and what we want. They bring vitality and joy to our days. But following your passion is a deceptively slow, uncertain way to purpose.

If I could tell myself anything three years ago when I graduated college, it would probably be this:

“Follow your passion, sure. But don’t expect it to produce your purpose.”

A Unique Approach To Discomfort

One may believe that a happy life eschews pain and discomfort by all costs. But, in truth, life opens up to us and expands when we’re squeezed and pushed through discomfort. Our emotional constriction, which creates our discomfort, begins to soften and expand when we lean into our discomfort. Moreover, our dreams are actualized through moments of confusion, doubt, fear, and uncertainty. So, when we’re pushed into our discomfort zone, we’re better able to witness and cultivate new skills that will propel us to new heights in our spiritual, emotional, and physical evolution.

How many of us can say that we have grown and transformed the most when we are “seemingly” sailing through life? Not many of us. When things appear superficially “perfect” and aligned in our lives, what could possibly ignite us toward growth and realizing God’s deeper purpose for our lives?

However, what indubitably pushes us toward greater fulfillment and purpose in our lives is when we’re tightly squeezed and pushed through discomfort. The physical manifestation of the contrast between what we deeply desire on a soulful level to what is actually showing up in our lives, creates the emotional and spiritual dissonance for us to push through and create transformation.

Transformation is accelerated in our lives through pain and discomfort. Such that, God will use different people, events, and circumstances to show up in our lives that cause us aggravation and distress, as a catalyst for growth and inspiration. Personally, I created a life that I dreamed of, living on a paradise island as a Life & Spiritual Coach & Teacher, not by coasting through life and feeling on top of the world. No. My life was radically changed when I hit my lowest point. When my pain and suffering had become enough.

Through pain and suffering, my heart opened up to greater transparency for God’s light to shine through and heal, motivate, and push me at deeper levels. Surely, the pressure was strong and tightening, but the more pressure I experienced, the harder I fought. Had I experienced continued success selling real estate in New York City, perhaps with money flowing in easily and effortlessly, and joy living in a city that stole my heart 19 years ago, I would not be living the life of my dreams right now. I’d still be living a life that was content and good, but truthfully, mediocre in the eyes of God. But, God doesn’t want GOOD ENOUGH for our lives, he wants GREAT!

So where is discomfort showing up in your life? Is it in a relationship? A job? Your living circumstances? Your finances? Your health? Or a lack of balance in your life? Consider each difficulty as a message that God has something better and more meaningful for your life. As we release the need to pity ourselves in difficult times and rather use discomfort as the catalyst toward change, we create an opportunity for greater richness and joy in our lives. Discomfort and pressure will always show up. To the extent that, although my life is greater than it’s ever been, there are newer and completely different experiences of discomfort that appear. But, with greater awareness I now recognize that my discomfort shows me that there’s still more for me to see and do in my life. This inspires me to work harder and explore my path with greater curiosity and determination.

Today, find peace with your discomfort. Embrace the stickiness. Ask for its lessons and guidance. Trust that your uneasiness is the vehicle to catapult you to places you’ve never been before. Use discomfort to your advantage in creating a life you dream of.

Trump Peddles The Plantation Myth About Blacks And Democrats

The GOP never tires of pitching the line in a presidential election year that the Democrats take black votes for granted and do absolutely nothing in return for those votes. The line goes that the Democrats’ alleged job killing, tout of entitlements, promotion of dependency and mind-numbing damp down of personal initiative have in effect created a modern-day plantation that traps blacks in perpetual poverty, horribly failed public schools, and run down crime ridden slums. They are for all practical purposes politically disenfranchised by being the handmaiden of the Democrats. Trump is the latest in the long train of GOP presidential contenders to peddle this line at campaign stops in Wisconsin and Michigan.

Now Trump didn’t go much further than this and make the pledge that some of the more delusional GOP contenders have and embark on a truncated, photo-op, charm tour to court Blacks. He knows that there’s no point in this given his hideous racial track record from barring Blacks from his apartment buildings, to his campaign for the death penalty for the falsely accused Central Park five, to his phony, fraudulent birther savaging of President Obama. He’s earned and richly deserves the near universal loathing he gets from Black voters.

Yet, Trump’s point still dangles heavily in the air that the Democrats routinely engage in a crude brand of plantation politics in that they win election after election with Black votes, but give nothing in return for that ever reliable support. More than a few Blacks have echoed this sentiment and ferociously ripped the Democrats for allegedly asking much of Black voters and giving little to them in return.

At first glance, there appears to be some ammunition for Trump to get some ink with the charge. The big cities with the highest levels of black poverty, underserved public schools, and high crime, as well as thorny issues with police violence such as Baltimore and Milwaukee, have long been run by Democrats, in most cases, Black Democrats. The GOP then endlessly tosses out gerrymandered figures on everything from jobs to jails to purport that Blacks have supposedly fared worse under President Obama than they did under presumably GOP presidents.

The absurdity of this is almost laughable. It’s even more laughable to make the case that Democrats and Democratic administrations are the cause of Blacks wallowing in poverty. And one doesn’t have to cite the Bush tax giveaways to the wealthy and big corporations, and slashes in spending on job and education programs. Or cite the GOP controlled Congress’s slash and burn of all Obama’s job and income initiatives and spending proposals to make the case that the blame finger for black poverty points to the GOP. According to Census data on unemployment and poverty, black families’ income grew far more and joblessness dropped far faster under Democratic presidents than under Republicans. The poverty rate for Blacks also showed a major plunge under Democratic administrations while it grew when a GOP president sat in the Oval Office.

Democrats have gotten the Black vote for nearly a half century for two brutal and compelling political reasons. The first is simple pragmatism. Most Blacks rely on the Democrats and civil rights leaders to fight the tough battles for health care, greater funding for education and jobs, voting rights protections, affirmative action and against racial discrimination. Even when Black Democratic politicians stumble and engage in borderline corrupt and self-serving feather their own nest antics, they are still regarded as better bets than Republican candidates to be more responsive to black needs. Black voters generally regard them as the politicians that accurately capture the mood of fear and hostility the majority of Blacks feel toward the Republicans.

The other is that many Democrats were the only ones that consistently fought back against Reagan, Bush Sr. and W. Bush’s draconian cuts in job, education and social services funding and programs, their retrograde nominees to the Supreme Court appointments that would roll back the civil rights clock, and their peck away at affirmative action, civil rights and civil liberties protections.

The GOP’s relentless and ruthless opposition to affirmative action, its duck, dodge, dither and flat-out obstruction of any and every initiative or legislation by President Obama on jobs, the increase in the minimum wage, strengthening social security protections, the dogged opposition to a slew of Obama judicial and administration appointees, and its hectoring and harassing of former Attorney General Eric Holder. Its manic and never-ending effort to torpedo the Affordable Care Act and the slew of nakedly race-tinged voting rights suppression laws it has dumped on the books in a handful of key electoral states has tagged it as an irredeemable enemy of Black voters.

Blacks, however, have been very much in Trump’s political play book. He’s used them as the perfect foil with his borderline racist digs, jibes, and slurs to drive disaffected, conservative, and other unreconstructed bigoted white voters to the polls. The hit on Democrats for allegedly running a plantation with Black voters is just another cynical and calculated page from that playbook.

Health Official Warns Zika Could Spread Across U.S. Gulf

Aug 21 (Reuters) – One of the top U.S. public health officials on Sunday warned that the mosquito-borne Zika virus could extend its reach across the U.S. Gulf Coast after officials last week confirmed it as active in the popular tourist destination of Miami Beach.

The possibility of transmission in Gulf States such as Louisiana and Texas will likely fuel concerns that the virus, which has been shown to cause the severe birth defect known as microcephaly, could spread across the continental United States, even though officials have played down such an outcome.

Concern has mounted since confirmation that Zika has expanded into a second region of the tourist hub of Miami-Dade County in Florida. Miami’s Wynwood arts neighborhood last month became the site of the first locally transmitted cases of Zika in the continental United States.

“It would not be surprising we would see additional cases perhaps in other Gulf Coast states,” Dr. Anthony Fauci, director of the allergy and infectious diseases unit of the National Institutes of Health (NIH), said in an interview on Sunday morning with ABC News.

Fauci noted that record flooding this month in Louisiana – which has killed at least 13 people and damaged some 60,000 homes damaged – has boosted the likelihood Zika will spread into that state.

“There’s going to be a lot of problems getting rid of standing water” that could stymie the mosquito control efforts that are the best way to control Zika’s spread, he said.

U.S. health officials have concluded that Zika infections in pregnant women can cause microcephaly, a birth defect marked by small head size that can lead to severe developmental problems in babies. The connection between Zika and microcephaly first came to light last fall in Brazil, which has now confirmed 1,835 cases of microcephaly that it considers to be related to Zika infections in the mothers.

On Friday, Florida Governor Rick Scott confirmed that state health officials had identified five cases of Zika believed to be contracted in Miami Beach.

The U.S. Centers for Disease Control and Prevention told pregnant women they should avoid the trendy area and suggested those especially worried about exposure might consider avoiding all of Miami-Dade County.

NIH’s Fauci on Sunday said the conditions of most of the country make it unlikely there would be a “diffuse, broad outbreak,” even though officials need to prepare for that possibility.

He compared it with diseases such as Dengue, which is endemic in certain tropical and subtropical regions of the world but rarely occurs in the continental United States. In Miami’s Wynwood area, experts have seen “substantial” knockdowns of mosquito populations.

Still, its containment is more complicated because Zika can be sexually transmitted, Fauci said.

“This is something that could hang around for a year or two,” he said.

The World Health Organization has said there is strong scientific consensus that Zika can also cause Guillain-Barre, a rare neurological syndrome that causes temporary paralysis in adults.

New York City Axes English Language Requirement For Taxi Drivers

NEW YORK (Reuters) – The average New York City taxi driver may still be sassy, but will not be required to speak English any longer.

The change is the result of a new law that Mayor Bill DeBlasio signed in April and went into effect on Friday eliminating the English proficiency exam for taxi and for-hire vehicle drivers.

It is the latest big change for cab drivers as policymakers and regulators try to adapt the city’s requirements to demographic and technological changes. The legislation created a single license for all taxicab and for-hire vehicles and eliminated the English language proficiency test, according to a New York City Council website.

The Council described the requirement as “a significant barrier to entry to driving a taxi” in a statement announcing the bill and other related legislation in January.

New York is home to nearly 144,000 active drivers of medallion cabs, livery cars and other for-hire vehicles, according to a 2016 report from the Taxi and Limousine Commission. Over 90 percent of those drivers are born outside the United States.

The Taxi and Limousine Commission is working with the Mayor’s office on a potential education program that would include English language vocabulary for drivers, a spokeswoman for Commission said.

The new law was part of a broader legislative package that also included a bill to require the Taxi and Limousine Commission to directly administer a health care services program.

When emotional intelligence first appeared to the masses, it threw a massive wrench into what many people had always assumed was the sole source of success–IQ.

How much of an impact does emotional intelligence (EQ) have on your personal and professional success? The short answer is: a lot! It’s a powerful way to focus your energy in one direction with a tremendous result.

Emotional intelligence is the “something” in each of us that is a bit intangible. It affects how we manage behavior, navigate social complexities, and make personal decisions that achieve positive results. Emotional intelligence is made up of four core skills that pair up under two primary competencies: personal competence and social competence.

Personal competence comprises your self-awareness and self-management skills, which focus more on you individually than on your interactions with other people. Personal competence is your ability to stay aware of your emotions and manage your behavior and tendencies.

  • Self-Awareness is your ability to accurately perceive your emotions and stay aware of them as they happen.
  • Self-Management is your ability to use awareness of your emotions to stay flexible and positively direct your behavior.

Social competence is made up of your social awareness and relationship management skills; social competence is your ability to understand other people’s moods, behavior, and motives in order to respond effectively and improve the quality of your relationships.

  • Social Awareness is your ability to accurately pick up on emotions in other people and understand what is really going on.
  • Relationship Management is your ability to use awareness of your emotions and the others’ emotions to manage interactions successfully.

Despite the significance of emotional intelligence, its intangible nature makes it very difficult to know which behaviors you should emulate. So I’ve analyzed the data from the million-plus people TalentSmart has tested in order to identify the habits that set high-EQ people apart.

1. They’re relentlessly positive. Keep your eyes on the news for any length of time, and you’ll see that it’s just one endless cycle of war, violent attacks, fragile economies, failing companies, and environmental disasters. It’s easy to think the world is headed downhill fast. And who knows? Maybe it is. But emotionally intelligent people don’t worry about that because they don’t get caught up in things they can’t control. They focus their energy on directing the two things that are completely within their power–their attention and their effort. Numerous studies have shown that optimists are physically and psychologically healthier than pessimists. They also perform better at work. Remind yourself of this the next time a negative train of thought takes hold of you.

2. They have a robust emotional vocabulary. All people experience emotions, but it is a select few who can accurately identify them as they occur, which is problematic because unlabeled emotions often go misunderstood, which leads to irrational choices and counterproductive actions. People with high EQs master their emotions because they understand them, and they use an extensive vocabulary of feelings to do so. While many people might describe themselves as simply feeling “bad,” emotionally intelligent people can pinpoint whether they feel “irritable,” “frustrated,” “downtrodden,” or “anxious.” The more specific your word choice, the better insight you have into exactly how you are feeling, what caused it, and what you should do about it.

3. They’re assertive. People with high EQs balance good manners, empathy, and kindness with the ability to assert themselves and establish boundaries. This tactful combination is ideal for handling conflict. When most people are crossed, they default to passive or aggressive behavior. Emotionally intelligent people remain balanced and assertive by steering themselves away from unfiltered emotional reactions. This enables them to neutralize difficult and toxic people without creating enemies.

4. They’re curious about other people. It doesn’t matter if they’re introverted or extroverted, emotionally intelligent people are curious about everyone around them. This curiosity is the product of empathy, one of the most significant gateways to a high EQ. The more you care about other people and what they’re going through, the more curiosity you’re going to have about them.

5. They forgive, but they don’t forget. Emotionally intelligent people live by the motto “Fool me once, shame on you; fool me twice, shame on me.” They forgive in order to prevent a grudge, but they never forget. The negative emotions that come with holding onto a grudge are actually a stress response. Holding on to that stress can have devastating health consequences, and emotionally intelligent people know to avoid this at all costs. However, offering forgiveness doesn’t mean they’ll give a wrongdoer another chance. Emotionally intelligent people will not be bogged down by mistreatment from others, so they quickly let things go and are assertive in protecting themselves from future harm.

6. They won’t let anyone limit their joy. When your sense of pleasure and satisfaction are derived from comparing yourself to others, you are no longer the master of your own happiness. When emotionally intelligent people feel good about something that they’ve done, they won’t let anyone’s opinions or accomplishments take that away from them. While it’s impossible to turn off your reactions to what others think of you, you don’t have to compare yourself to others, and you can always take people’s opinions with a grain of salt. That way, no matter what other people are thinking or doing, your self-worth comes from within. Regardless of what people think of you at any particular moment, one thing is certain–you’re never as good or bad as they say you are.

7. They make things fun. Emotionally intelligent people know exactly what makes them happy, and they constantly work to bring this happiness into everything they do. They turn monotonous work into games, go the extra mile to make people they care about happy, and take breaks to enjoy the things they love no matter how busy they are. They know that injecting this fun into their lives fights off stress and builds lasting resilience.

8. They are difficult to offend. If you have a firm grasp of whom you are, it’s difficult for someone to say or do something that gets your goat. Emotionally intelligent people are self-confident and open-minded, which creates a pretty thick skin.

9. They squash negative self-talk. A big step in developing emotional intelligence involves stopping negative self-talk in its tracks. The more you ruminate on negative thoughts, the more power you give them. Most of our negative thoughts are just that–thoughts, not facts. You can stop the negative and pessimistic things your inner voice says by writing them down. Once you’ve taken a moment to slow down the negative momentum of your thoughts, you will be more rational and clear-headed in evaluating their veracity. You can bet that your statements aren’t true any time you use words such as “never,” “worst,” and “ever.” If your statements still look like facts once they’re on paper, take them to a friend and see if he or she agrees with you. Then the truth will surely come out.

Bringing It All Together

Unlike your IQ, your EQ is highly malleable. As you train your brain by repeatedly practicing new emotionally intelligent behaviors, your brain builds the pathways needed to make them into habits. Before long, you will begin responding to your surroundings with emotional intelligence without even having to think about it. And as your brain reinforces the use of new behaviors, the connections supporting old, destructive behaviors will die off.

Back to School Means Heavy Backpacks And Back Pain

With school is just around the corner, children will be abandoning the playground and returning to the classroom. With an emphasis on providing a sound education for this young generation, children are given a literal “heavier” workload year after year. This has translated into more books and more accessories, which greatly contributes to the normalcy and reliance on carrying backpacks. However, despite their usefulness, backpacks can cause serious back pain if overloaded or worn improperly.

To understand how heavy backpacks contribute to back pain, it’s important to look at the composition of the back. The adolescent spine is composed of 33 bones called vertebrae with discs between them that act as natural shock absorbers. When a heavy backpack is incorrectly placed over a child’s shoulders, the weight of the bag can force the child backwards. Usually, children counteract this force by arching or bending forward at the hips, causing the spine to compress unnaturally and contributing to neck, shoulder and back pain.

The best way to prevent lower back pain is to either avoid overstuffing a backpack. According to the American Academy of Orthopaedic Surgeons, children should limit their backpack weight to between 10 and 15 percent of their body weight. Backpacks weighing more than this are too heavy to maintain a standing posture. This weight causes children to lean forward, affecting the natural curve in the lumbar and lower back regions resulting in variety of orthopaedic injuries.

Dr. Ebraheim says,
“Kids these days think backpacks are moving libraries, carrying heavier weights back and forth to school and between classes without taking breaks. The weight can cause a variety of back problems including scoliosis. This is a problem not only for the child’s health but also because back pain can interfere with the learning environment. Kids need to feel healthy during the day so they can keep up with their schoolwork injury free.”

Wearing a backing improperly can also cause back injury. Many times children will sling their backpacks over only one shoulder. This uneven distribution of weight causes the child to compensate by leaning to one side. The frequent imbalance causes muscle strain. The problem can be exacerbated if backpacks have tight or narrow straps, as they can interfere with circulation and nerves.

There are, however, some simple ways to prevent your child from developing back pain. First, it’s important to monitor the weight of children’s backpacks to ensure that they are not overloading them. Second, purchase a backpack with wide, padded straps to distribute the load over the shoulders evenly. Backpacks that have waist and additional shoulder straps may also prove beneficial in transferring the load to the hips and preventing slouching. Lastly, it’s important to concentrate the bulk of the weight closest to your child’s body in the middle of the back. This will help your child achieve better posture and balance, while preventing possible falls.

Does ‘The Bern’ Still Have Heat? Colorado 69 Is Thermometer

Weary. A nice, tired word that describes how most folks I know feel about the current Presidential election cycle.

Weary, of Trump, tired of the coverage and weary of being tired of it all. So for people who like politics, or are at least concerned about what is going to happen in November, which should be all of us, what’s to do?

Look down ballot. The Senate is in play, the numbers could change in Congress, and there are plenty of ballot measures you’ll have to consider in November at your local polling place, or at your kitchen table when you decide to vote early by mail. In fact much of the true ‘democratic process’ that we Americans are so proud of takes place down ballot. Measures that affect your local schools, or roads, or dope supply-we’re voting on legalization of marijuana where I live. One of the most interesting such items is the Colorado State Health Care System Initiative, Amendment 69.

Catchy title.

In short, it’s a proposed amendment to the Colorado state constitution that will create universal health care for all Coloradans. Every one, for all health care issues, including mental. As you would expect there are those who think supporting such a idea qualifies you for having your head examined. Those in favor agree, just not on which heads. It’s basically a single payer system which will be paid for by a new 10 percent state payroll tax. Employees will have an additional 3.33 per cent taken out of their pay checks, the employers will kick in the additional 6.67 per cent. Self employed folks or businesses with no payrolls will pay the full 10 percent extra. The new tax would raise a projected 25 billion dollars per year to fund ColoradoCare, that’s what they’re calling it. It would not be administered by the state but rather by a board of trustees, elected by the residents of Colorado. ColoradoCare would be responsible for administering Medicaid, basic health care for kids, all other state and federal healthcare monies and working with health care providers to create a seamless system. Well, maybe not seamless… This is all outlined in a 43 page booklet that supporters of the measure put together.

If this all sounds familiar it’s because you’ve heard it before. Single payer health care systems have been discussed for years, most recently and most passionately by Senator Bernie Sanders in his run for the Democratic Presidential nomination. It is an idea, among many in Senator Sanders’ campaign, that lit a fire beneath the new political wings of the ‘millennial generation’. I’ve never really understood that term, so let’s just say that a lot of people, millions actually, loved Sanders and most of his ideas, including universal healthcare and a single payer system much like the Colorado proposal. Many of those smitten were young, first timers, newbies. Unfortunately, as often happens with affairs of the heart, love waned when the Senator came up short in his battle with Hillary Clinton. In fact, it’s been a while since I’ve even seen or heard of Sanders. Where did he go?

More importantly, where did his supporters go?

I bring this up because while candidates come and go, ideas do not. True politics and political action can not be a ‘take my ball and go home’ sport. That’s what looking down ballot is all about.
So does ColoradoCare stand a chance? It all depends on how much passion is left over from the Sanders campaign. Does ‘The Bern’ still have heat? Sanders easily won the Colorado Democratic Caucus, 59% to Hillary Clinton’s 40%. Clinton, by the way, is on record as opposing Amendment 69, as does the Democratic Governor, the current Democratic Senator, and a whole list of predictable opponents, including the insurance industry and business groups. The arguments are also the expected ones–it’s too expensive, will drive business out of the state, will cause an influx of people looking for a ‘free ride’, bureaucrats will be making healthcare decisions and so on. They also point out that Vermont, Senator Sanders’ home state, tried a system very similar, and it failed, miserably.

Those who favor the measure, including the League of Women Voters of Colorado, Noam Chomsky, and a number of unions, have a different opinion of course. In the world of psychology, derailment describes thought processes that veer off track, go awry, stray from the thought. Like a car that has skidded off the road, the ideas fail to arrive at their destination. In the realm of politics, derailment refers to a tactic by those in power that deflects attention away from complaints about abuse or wrongdoing by introducing an alternative topic. This blog explores derailment as a diversion from a life goal, and how it’s possible to get back on course.

In his journal, the writer John Cheever alluded to a loss of continuity at a critical point in his life. “It seems that in my coming of age I missed a year–perhaps a day or an hour….The consecutiveness of growth has been damaged. But how can I go back and find this moment that was lost?” Although the impact of Cheever’s derailment extends beyond the scope of this blog, his expression highlights the common problem.

In the newly released movie, Florence Foster Jenkins, the heroine, Florence, contracted syphilis from her first husband. As a result, she didn’t bear children and was deprived of a fulfilling family life. That derailment led her to devote her life to singing and supporting the musical world with the fortune she inherited from her father.

We assume an extreme diversion is equivalent to a disaster, but the event may actually represent a chance to recover a “lost” direction or passion. The classic story of The Little Prince (recently made into a popular movie) can be viewed as a metaphorical derailment in the realm of literature. As a young boy, the protagonist of the story drew a boa constrictor swallowing an elephant. But the adults insisted that the drawing resembled a hat. Unimpressed with the child’s skill, the grown-ups redirected him from artistic to practical studies– geography, history, arithmetic, and grammar. “That is why I abandoned, at the age of six, a magnificent career as an artist,” the protagonist says, justifying his profession as a pilot. Years later, his plane crashed in the middle of the desert, and he was visited by a little prince who commanded him to draw. The little prince may well represent the pilot’s imagination or alter ego that harbored his desire to become an artist.

In real life, a patient of mine, Ms. W., experienced a serious depression, a kind of psychological crash. During her hospitalization, she recalled that in her youth, she had aspired to become a singer. In the hospital, she had the opportunity to connect her depression with the long-forgotten ambition. Upon her recovery, she studied voice and became a successful musician.

Conclusion: Although we can’t undo the past, we can recognize a derailment and take action to get back on track.

In Public Policy, Profit Should Not Be a Dirty Word

Jeremy Corbyn? Sensible policy suggestion? No, I am not living in some kind of parallel universe where the Labour Party have a 15 point lead in the polls and Jeremy Corbyn is widely regarded as the greatest opposition leader of this or any other age. But even a broken clock tells the time correctly twice a day. This, of course, is with regards to a policy proposal put forward which wants to put the British railway services back into public ownership. It is something which has been favoured by the British public for a long time now, and it is not the first time the Labour Party has toyed with the idea in the last decade. Of all of the privatisations that took place under the watch of Margaret Thatcher and John Major, rail has been by far the least successful. Difficulty in driving down real prices for rail fails, floundering service quality and an industry which seems entirely unwilling or unable to innovate; all have contributed to the public perception that it was a mistake that ought to be rectified. By the same token, recent announcements by the US Justice Department have made it quite clear that there is no appetite to continue making use of private prison facilities. As it was put quite bluntly by the Deputy Attorney, “They simply do not provide the same level of correctional services, programs, and resources; they do not save substantially on costs; and … they do not maintain the same level of safety and security,” A damning indictment indeed for private sector involvement in the provision of public services.

This shall provide fuel to the flames of those who make vacuous and sweeping declarations such as ‘People before Profit’ or to ensure that ‘our’ public services continue to be provided by the state as a point of principle. However, it is this exactly this sort of thinking which results in the making of bad policy. There are a number of examples where profit has been harnessed in a way that it can be beneficial to the masses. Is there any better example than the pharmaceutical industry. Yes, big pharma has a tendency towards moral bankruptcy the moment the name ‘Martin Shkreli’ is uttered. But it is through the ability for these firms to be able to reinvest large profits into costly research and development which has saved millions of lives all over the globe. It is possible for international pharmaceutical companies to cross subsidise medicines in impoverished countries, in a way that national governments would never have an incentive to do. The other example are much maligned financial products. The provision of private pension funds and insurance products ensure that those who face risks can mitigate them. In the process of allowing such firms to make profits, they secure the financial future of themselves and their families.

Indeed, it seems that policy makers of the left have missed a trick. What most people desire in vital areas such as education and healthcare is high quality, free at the point of use. Who is providing such a service is very much a peripheral concern if you have a broken leg which needs to be fixed, or are expected to pass a standardised set of exams at 16, 17 and 18. The real aim ought to be to ensure that this is the case in all industries, and that such a set up is sustainable for the public purse in the generations to come. Alas, we have come to a time and a place in world politics which is so polarised that to say such a thing is either; to be the enemy of free markets, or to be a neoliberal scumbag who wishes to exploit the working classes. But one should never care for labels. Profit is not the dirty word we have cracked it up to be. There is, however, a phrase that really ought to strike fear into all of our hearts. That word is inefficiency.

When the King’s Fund (a leading UK healthcare think-tank) talks about the ‘growing crisis in the NHS‘, the greatest concern is not the involvement of the private sector. Instead, it is the inefficiency in the way in which administration is undertaken and resources allocated that are seen as the greatest challenges facing any government’s health policy. Yes, investment is a crucial plank to good healthcare. But having a system which cripples doctors and prevents them from what they really want to do (just in case anyone is unsure, that is treat patients) is a far greater threat. And yes, the British left found its reactionary streak and treat the NHS in its current form as gospel. What many fail to realise is that, if there are not radical changes to the way in which the NHS is governed and structured, then an economic downturn could result in the nation defaulting onto the woefully substandard American private insurance model. Public policy is all about outcomes, and to forgo better results because somebody makes more revenue than they do costs is the most painful folly.

This is not to say that profit is some kind of inherent good, or that the private sector should be the only port of call in all public sectors. This framework of inefficiency helps to explain why it is that rail privatisation (especially the half baked model of the UK which created local monopolies and kept the infrastructure in public ownership). Indeed, my secondary school level understanding of economics tells me that to have an industry which has low scope for service innovation, high sunk costs and capital maintenance costs, and faces challenges by alternative forms of transport is likely to have monopolistic tendencies. You cannot try to force competition in an industry which is simply not set up for it. Thus you are left with the only options that will allow you to operate with the necessary cost structure and economies of scale. That is private monopoly or public monopoly. Given the valuable nature of having an accessible rail service which all working professionals can utilise, the latter sounds like a more appealing option.

But this was a decision that was not based on how much money was being made by business executives. Until we keep up the ‘ideologically pure’ pretense that this is what we really ought to care about, then policy will continue to flounder. When it comes to the services that so many of the impoverished and disadvantaged are reliant upon, there is no time for zealotry.

Living Richly With Less

In the past five months, I have thrown away hundreds of items in my apartment. It hasn’t been easy to let go of some things, but it has always been worthwhile. Part of this process has been practical as my girlfriend is moving in with me in a 230 square foot apartment. Most of the process has been personally fulfilling as it has made me feel more free an unencumbered.

Minimalism is not a new concept. It has been made popular by bloggers like Leo Babauta at Zen Habits and it seems to be a trendy thing to do. Some people may do it out of a sense of uniqueness or superiority, but I have my own reasons. Namely, living with less actually helps me to live more richly.

The Art of Living with Essentials

The concept of essentialism is far more appealing to me than minimalism. Instead of getting rid of everything, I get rid of only the things that are non-essential. I strip to the core, find what is most essential and remove everything else. Here are a few benefits and examples of living a rich life within the framework of essentialism:

1. Your possessions own you – Recently I had a conversation with a friend who is making around $ 12,000 a month. It’s a high salary for Texas, but he has so many possessions, most of the money ends up gone by the end of the month.

Many Americans exist with possessions like this. The home mortgage is so expensive that families aren’t free to travel. Boats, cars, and a host of other features people rarely use all cost money and restrict freedom. According to some estimates, Americans spend $ 1.2 trillion on things that are non-essential.

2. We fill up a space no matter the size – According to the LA Times, the average home is filled with 300,000 items. Most people fill up the space that they are given no matter what the size is. If they have a two-car garage, most cannot even fit their cars because of all the other possessions.

This is one of the reasons the tiny house movement has become so strong. My girlfriend and I live in a tiny apartment and may one day purchase a small, efficient home. Even when we visited the coast in Australia we spent time renting a tiny home. It just makes more sense, but it also feels much better. The burden is lifted to be in a smaller space because we can’t fill it with things we don’t need even if we tried.

3. Mental toughness – In life you will face trials, discomfort, and pain. That is the human condition. How we react to such trials and discomfort is dependent on how much practice we have. The reason people become spoiled is because they have consistently never had to deal with hardship and discomfort.

Living with less is sometimes not as comfortable. You might feel cramped, unable to do the things you’d like, and there is no room for luxuries when basic necessities barely fit. But these are all things that inoculate you from mental strain in the future.

The ancient stoic philosopher, Seneca, used to dress in the cheapest clothing and eat nothing so as to practice poverty. It was a way for him to intentionally build his mental toughness despite having plenty.

Radical Essentialism

At first it may seem difficult to be an essentialist, but it might be helpful to burn the boats and go all in. By becoming a radical essentialist you don’t just have a change in your physical surroundings. Sure, you’ll reduce your material possessions and free yourself from their burden, but you also have a psychological change. You will start to see the non-essentials in your life, such as people you’d rather not be involved with, poor habits you engage in, and others. You’ll find this to be a movement that changes the way you live and the way that you think.

Comment Sections Are Cesspools Of Rape Culture, Research Finds

One-fourth of all online comments at the end of news articles about sexual assault and rape include victim-blaming statements, new research out of the University of Southern California shows.

The study examined 52 articles and found that only one did not contain comments offering support for the accused perpetrator, the study said. Victim-blaming statements appeared in 1,097 of the 4,239 comments ― or just over 25 percent of them. 

“I was surprised that so many people were so mean about these victims,” Kristen Zaleski, associate professor at USC’s School of Social Work, told The Huffington Post. “Even knowing what I know about rape culture, I didn’t expect so much hate and judgment and discriminatory attitudes and othering ― there was a lot of othering.” 

Branded as a “first-of-its-kind study,” the researchers examined comments posted to rape-related articles published in the The Wall Street Journal, The New York Times, USA Today and the Los Angeles Times between December 2014 and March 2015. In total, they looked at 52 newspaper articles covering everything from Bill Cosby’s accusers coming forward to the fallout from Rolling Stone’s flawed article on campus rape

If the accused perpetrator was a celebrity or public figure, the individual was more likely to receive support ― or commenters were more likely to attack the alleged victims. 

About 16 percent of all comments included statements of support for survivors, while 6 percent offered support to the accused assailants and 23 percent included “trolling” statements about law and society, the study concluded. 

Victims received more support and sympathy when the alleged perpetrator was not an American citizen or the assault occurred abroad. But in those cases, the victim-blaming comments were replaced by racist remarks.

The researchers found that one of the most common victim-blaming responses was when commenters gave instructions to rape survivors ― for example, telling them that they should have gone to the police immediately.

That’s not an uncommon reaction: This week, comedian Kurt Metzger went on an extended social media tirade about rape allegations against a fellow comedian, Aaron Glaser. Many of Metzger’s comments criticized victims of sexual assault for not immediately reporting their attacks to cops.

Comments like this send an implicit message to rape victims that “If this is true, report it,” Zaleski said. “It’s very directive and almost dismissive.”

In articles about celebrities accused of rape, readers would suggest there was a conspiracy afoot. In an article about Bill Cosby, for example, a commenter said that “anyone who doesn’t recognize the political agenda behind these attacks on Cosby hasn’t been paying attention.”

Other commenters suggested that the survivor’s story was too unbelievable to be real or that too much time had passed for it to be real. They also accused victims of playing the “rape card,” or suggested they made up the charges after getting too intoxicated.

“There needs to be a law to protect men and teenage boys from charges made against them for rape or sexual misconduct by women and girls who are stupid enough to get drunk and allow this to happen then turn around and blame the male,” one commenter cited in the study said. 

The researchers also discovered a lot of disbelief that men could be assaulted. For example, one comment read: “Ask any guy, it is impossible for any man, especially a teenager, to be ‘raped’ by an NFL cheerleader!”

Some of the comments that blamed the victim also fell under the “trolling” category. These were more likely to bring up ― and then dismiss ― the idea of “rape culture,” denying that sexism, bigotry and inequality create a toxic environment that encourages rape. Conversations about “rape culture” in comment sections often turned into debates about statistics. 

“The people who had opinions about who’s to blame, who were basically blaming the survivors or victims, they would use the words ‘rape culture,’” Zaleski said. “They would be somewhat up on the topic and [say] it was bullshit, and one of the ways they would do that is talk about false reporting.”

Often, someone would defend the survivors in the comment sections by posting links to articles about how rare false accusations are, Zaleski explained. The victim-blaming commenters would question the source of the stats, and then there would be a data conversation, she said. 

The study, “Exploring rape culture in social media forums,” will be published in the October 2016 issue of Computers in Human Behavior.

Donald Trump Calls The Slavery Era A Good Time Before Reaching Out To Black Voters

Republican presidential nominee Donald Trump tried to improve his abysmal image with black voters during a Wisconsin trip on Tuesday. But he fell flat even before he got started, with some tone-deaf comments to the La Crosse Tribune.

Buried deep in that interview was a very Trumpian idea of what periods in American history were great and what made them so awesome:

Trump, whose campaign slogan is “Make America Great Again!” said he views the 1980s as the time when things were good for the nation, though he also hearkened back to the late 1700s and early 1800s.

“The industrial revolution was certainly ― in terms of economically ― that was when we started to grow,” Trump said. “I liked the Ronald Reagan years. I thought the country had a wonderful, strong image.”

There’s a lot to unpack in those racially insensitive comments.

The Industrial Revolution may have been a great time for white Protestant cisgender men. For everybody else, the memories are not so good. Lest Trump has forgotten, black people were enslaved in the U.S. until the 1860s. Afterward, strict Jim Crow laws barred them from freely sharing public spaces with white people, essentially legalized lynchings and effectively disenfranchised black voters. It wasn’t until the passage of the 1965 Voting Rights Act that many black Americans were truly able to cast ballots.

As for the 1980s under President Reagan, that’s when the crack cocaine epidemic swept through many black communities, and the war on drugs drove incarceration rates for black people through the roof.

Though Trump made clear that he was focusing on the economic benefits of the Industrial Revolution, he failed to note how much that revolution was built on the backs of enslaved Africans in cotton fields.

Those remarks show once again why Trump ― who was polling at zero percent of the black vote in July ― has so much trouble in appealing to African-American voters, according to Brandon Weathersby, communications director of the Democratic Party of Wisconsin.

“There has not been a full-throated, full-hearted effort to make the case to people of color of what Donald Trump will do for them and do for their community,” Weathersby told The Huffington Post.

On Tuesday night, Trump tried to argue ― to a mostly white crowd in West Bend, Wisconsin ― that he is the candidate who will best represent the interests of black Americans.

The GOP nominee vowed to restore “law and order” via “more law enforcement, more community engagement, more effective policing is what our country needs.”

“Those peddling the narrative of cops as a racist force in our society ― a narrative supported with a nod by my opponent ― share directly in the responsibility for the unrest in Milwaukee, and many other places within our country,” Trump said. “They have fostered the dangerous anti-police atmosphere in America.”

“Every time we rush to judgment with false facts and narratives ― whether in Ferguson or in Baltimore ― and foment further unrest,” he continued, “we do a direct disservice to poor African-American residents who are hurt by the high crime in their communities.”

West Bend is about 40 miles north of Milwaukee, the most racially segregated major metropolitan area in the country and a city that has been shaken by violent protests following the death of Sylville Smith. The 23-year-old black man was shot and killed by Milwaukee police on Saturday. 

The protests were driven by more than Smith’s death and police abuse. Black residents also expressed anger over destructively high incarceration rates, poorly funded schools and much else. 

But Trump’s speech focused mainly on bettering life for police officers and essentially accused black people of causing problems by raising their voices. 

It didn’t sound like Trump had heard what African-Americans were saying at all.

“It really sounds like Donald Trump just sees people of color [and] communities of color as potential votes,” Weathersby said.

Meditation For A Blessed Election

I started writing guided meditations more than ten years ago. As a health and wellness coach I write them for myself to prepare for important trips and events. I write them for friends who are having medical procedures. I help clients write them. And a while back, when this toxic election season was really beginning to affect my peace of mind, I decided to write one specifically about the election. I, like many other Americans of both parties, was having “Trump anxiety.”

At the same time it’s not just politics on my mind. I have been moved and saddened by the many police shootings and terrorist attacks during this difficult year, and kept wondering what I could do to make a difference. How could I use my gifts to help?

I was hesitant to share this publicly because anything related to politics brings down a rain of toxicity and hatred upon the writer and I didn’t want to have that directed at me. After sharing it in my writers’ group and seeing its impact on several listeners, I decided I would share it with my intention for the best possible outcome.

Feel free to take it and make it your own, changing the wording as needed to suit your worldview. I hold on to the hope that most Americans want to feel good about our democratic process and our country. I love the idea of people across the country reading versions of this every day, amplifying its effect in the world. I hold on to the belief that it will make a positive impact on our country in the coming months.

Meditation for a Blessed Election
Guide me in conversation today with others who disagree with me.

Let me come to those conversations with an open, loving heart.

Guide me as to what actions I should take today to help move our beautiful country forward, and give me clear direction on how to do so.

Help America live up to her inclusive ideals.

Pour out your healing on the racism that still divides our country.

Let hatred be a thing of the past.

Help retrain our police officers where needed, while keeping them safe on the job.

Help heal those communities torn apart by gun violence with real, tangible progress and real solutions.

Help those of us with any kind of privilege use it for healing and justice and the betterment of all.

Bless the candidates near and far. Bless those running for office who are motivated by service and the higher good.

Protect her from the hatred that is directed at her, surrounding her with a circle of light and powerful protection that is physically represented by the Secret Service. Keep them safe in their jobs and diligent while on duty.

I lift up all the candidates, surrounding them with love, support, and my highest intention for the good of the United States.

Let those who have the country’s highest good in mind, of either party, be blessed with an abundant flow of money, volunteers, and media support.

Let their supporters come forward in the hundreds of millions now and on November 8th. May we have the highest voter turnout in history.

May those people who will work together for the common good of our country and their constituents be elected in landslides.

What Are Your Options if Medicaid Goes Broke

Americans are living longer than ever.

With that longer life span comes increasing reliance on long-term healthcare services.

And costs associated with in-home care services, nursing homes, and other residential facilities are on the rise.

The primary payer for long-term care is Medicaid, the joint federal and state program designed to help Americans with limited incomes pay medical costs.

“Government programs such as Medicaid and the like may not necessarily be around going forward to provide assistance,” said Money Crashers finance expert David Bakke.

Bakke told Healthline that Medicaid is projected to run out of money in the year 2030, or perhaps as early as 2026.

“Medicaid will certainly have a challenge when it comes to handling the strain of long-term care for seniors and retirees,” he said. “You could make the argument that already the needs of the elderly aren’t being met in a satisfactory fashion under the current system. In fact, 37 percent of long-term care costs are currently being met with out-of-pocket funds.”

According to Bakke, some states are putting the onus on providers to keep care costs under control.

The realities of long-term care

Melissa Benjamin is a home care worker in Colorado and a leader in the Home Care Fight for $ 15. She’s in the trenches of home care services every day.

In addition to our aging population, she believes other factors are fueling the Medicaid crisis.

In an interview with Healthline, Benjamin said there’s already a shortage of home care workers, and she expects it to get worse. As more experienced workers age out of the workforce or look for employment elsewhere, fewer workers are willing to take up the slack.

“It’s no longer a viable career,” said Benjamin. “Low pay and lack of benefits keep people from choosing this type of work.”

The worker shortage is creating a care gap that forces difficult choices. When family members shoulder more of the care burden, it’s often at the expense of their own employment. Placing a loved one in a facility isn’t always the best option for them or for the family budget.

Although Medicaid covers both types of care, in-home care is often less expensive by several thousand dollars a month.

“It’s one reason I fight for home care. I believe by making home healthcare a viable career, we can keep more people in their homes and save the states money in the long run,” said Benjamin.

For some people, nursing home care is a must. But Benjamin believes many others can be happier and healthier being cared for in their own homes.

“In Colorado, about 10,000 people become seniors every day,” she said. “That’s a strain, and it’s true all around.”

Then there’s the gender gap.

At 37 years old, Benjamin is already concerned about her own healthcare needs as she ages.

“A higher percentage of home care workers are women. We make less, have fewer benefits, and pay less into Social Security. Often, women who cared for their husbands are left alone and needing care themselves. Plus, we live longer, so that time is more challenging.”

In Benjamin’s experience, long-term care insurance policies can save the day. The key is to sign up when you’re younger and rates are at their best.

Unfortunately, when rates rise, many aren’t able to keep paying the premiums. That can result in having to sell off assets to apply for Medicaid.

“I’ve held the hands of people in facilities as they cry. They want to go home, but their home has been sold to pay for facility care,” she said.

Planning for long-term care

Seniors, soon-to-be seniors, and caregivers can’t start planning soon enough. It’s a complicated issue and there’s no one-size-fits-all solution.

As alternatives to insurance and government programs, Bakke recommends a health savings account when applicable, a home equity line of credit, and in some cases, a long-term care annuity.

“In some instances,” said Bakke, “you might be better off foregoing long-term care insurance and paying for whatever costs are left over out of pocket, because of the high cost of paying for insurance coverage in that area.”

According to the Kaiser Family Foundation, most seniors can’t afford the out-of-pocket costs of long-term care.

Jennifer FitzPatrick, author of “Cruising through Caregiving: Reducing the Stress of Caring for Your Loved One,” would like to see more public education about long-term care and Medicaid.

“There really needs to be a paradigm shift so older adults and their families are not counting on Medicaid because of misunderstanding,” said FitzPatrick, who has worked as a gerontologist and geriatric social worker for more than 25 years.

“I’d love to see Medicaid encourage more people to consider long-term care insurance, which covers much more than Medicaid can,” FitzPatrick told Healthline. “I wish I saw more being done so caregivers and older adults weren’t in crisis.”

FitzPatrick recommends consulting with a certified elder law attorney.

Benjamin and Fitzpatrick agree that consumers have a lot more options when using private funds than they do when using Medicaid.

“It’s important also for families and older adults to know that often when they do use a Medicaid benefit for a nursing home, for example, they aren’t getting as much choice,” said FitzPatrick. “Sometimes patients and caregivers are dissatisfied with the nursing home options available for a direct Medicaid admission.”

Americans are optimistic. We tend to underestimate the risk of needing long-term care.

The U.S. Department of Health and Human Services estimates that half of seniors over age 65 will have a health problem and need assistance for two years or less.

One in seven will need assistance for more than five years. Those turning 65 now can expect $ 138,000 in future long-term care costs. In many cases, costs will be much higher.

Having a long-term care policy is a good idea, if you can afford it. Most can’t.
As of 2014, fewer than 8 percent of Americans have private long-term care insurance.
Medicaid was never meant to cover long-term care for so many.

“I can’t count the number of caregivers who have incorrectly assumed that Medicare or Medicaid would pay for assisted living or indefinite home care services,” said FitzPatrick.

    Poll Shows Millennials Increasingly Worried About Police Brutality, Criminal Justice

    A new USA Today/Rock the Vote poll of Americans under 35 finds that millennials are increasingly concerned about civil rights, police brutality and criminal justice reform.

    The results, released Monday, show that criminal justice reform is now nearly as important to millennials as the economy, college affordability and foreign policy. Nearly one-quarter of those surveyed believe problems in the criminal justice system will be the most important issue for the next president. Only 17 percent of respondents said that in a similar January survey

    Additionally, 72 percent of millennials surveyed believe “police violence against African Americans is a problem,” an increase of 11 percentage points since the January version of the survey.

    The poll was conducted prior to the violent protests that erupted in Milwaukee in response to the fatal police shooting of Sylville Smith, a 23-year-old black man. Officers opened fire on Smith on Saturday as he fled a traffic stop, reportedly after confronting police with a gun in hand.

    The unrest in Milwaukee follows a string of protests against police brutality toward black men and women in major U.S. cities over the past few years.

    Opinions about the intersection of police violence and race remain sharply divided along partisan lines, according to a USA Today story accompanying the release of the poll. By a margin of 6-1, supporters of Democratic presidential candidate Hillary Clinton say police brutality against black Americans is a problem. Supporters of Republican presidential candidate Donald Trump, however, are split in their responses.

    Meanwhile, 75 percent of Clinton supporters and 88 percent of Trump supporters say they are “very concerned about the safety of police officers doing their jobs in the current political environment.” 

    While tensions between police departments and black communities continue to fester, Election Day is fast approaching.

    Younger voters overwhelmingly support a Clinton presidency, according to the poll, which finds that 56 percent of millennials would support Clinton and only 20 percent would support Trump in a two-way race. Meanwhile, 15 percent say they won’t vote.

    But even when Libertarian Gary Johnson and the Green Party’s Jill Stein are added to the fray, Clinton gets 50 percent support from younger voters, while Trump wins a meager 18 percent. Johnson walks away with 11 percent and Stein takes 4 percent, while another 8 percent say they’re unsure who they’d vote for and 10 percent say they will not vote.

    The poll was conducted by Ipsos Public Affairs from Aug. 5-10 and surveyed a national sample of 1,539 adults ages 18-34.

    Letting Go Of Toxic People

    Clearing our bodies of toxins isn’t always about what we eat or drink. Sometimes removing the poison means you have to make the difficult decision to cut toxic people out of your life to heal your soul.

    It’s not an easy task.

    Sometimes we aren’t even aware of the damage being caused from the negative energy of a friend or family member.

    We don’t notice when someone is trying to control us. The signs are missed. You don’t understand why you are agitated, annoyed, and anxiety ridden in someone’s presence until you take a step back and get in touch with your inner self.

    You don’t recognize that you often keep silent and resist the urge to defend yourself, to speak out when you are hearing lies. You give excuses as to why someone behaves the way they do because they have been there for you often over the years and you afraid to lose that perceived support.

    I live by my emotions, and don’t always understand why I feel the way I do around certain people. It isn’t until I have “fact” that I can step away.

    Maybe it’s the reporter in me — there is always two sides to a story. I try very hard to see every angle. Even if my instincts are telling me to walk away, I have a hard time cutting the anchor because I don’t want to ever be seen as “mean” or “bad.”

    My insecurities often get the better of and have been used against me. But slowly I’m starting to emerge from my shell.

    Maybe it’s getting older. You start to realize that not everyone has your best interest at heart. Some people like when you are in crisis because it fulfills their want to be needed. They feed off the drama.

    They fill your head with half-truths and half-lies, making you believe things about yourself that you know aren’t true. They put a slant on every story in order in order to make themselves able to fit the role they’ve created.

    For their story to work you have to be the antagonist or partner in crime because otherwise they will have to come face to face with themselves in the mirror.

    It’s not easy to let go of the friendships, relationships and family loyalties that cause you pain.

    But in the words of my friend Deb,

    “If you need to cut ties, do it, and find those kind-like souls that can feed your spirit.”

    The braver you are and recognize and remove those hurting you, the more room you have to be your true self and let the right people in who lift you up, not weigh you down.

    This Gold’s Gym Advertisement Is A Horrible, Sexist Mess

    Gold’s Gym has come under serious fire after an Egypt location posted a horribly sexist ad onto its Facebook page last weekend.

    Gold’s Gym Dreamland, located in Giza, shared a photo of a pear, with a caption that left an offensive message to women everywhere: “This is no shape for a girl.”

    The post has since been removed after the picture received a ton of criticism ― which was rightfully deserved. The ad was hugely sexist, and a perhaps misguided nostalgic nod to the horrendously misogynistic ads of the 1960s and 1970s:

    The branch issued an apology on Monday by simply posting a photo of the company logo with the words “Our Apology” above it, and a bizarre message in the caption:

    Our apology, this post was not meant to offend anyone, and not against god’s creation, or any type of women’s body, it was meant to refer to a Healthy Fit body and cutting fats, NOT THE ACTUAL STRUCTURE OF THE BODY.

    So Again our Apology. for all the women out there.

    A more substantial apology from the company was posted onto the Gold’s Gym Egypt page today. “Gold’s Gym Egypt was built on values that would only encourage men, women, and children alike to love themselves proudly, regardless of their weight or physical appearance,” it reads. 

    But Facebook users aren’t so forgiving.

    “Now women everywhere know what kind of philosophy your gym has and they can avoid it,” one commenter wrote. Another wrote, “Health and fitness come in all shapes and sizes. Marketing your business and profiting based on people’s fear of prejudice is ugly.”

    Ugly indeed.

    So here’s a quick reminder while we’re here: Women’s bodies are not fruit, and they come in all kinds of glorious shapes and sizes that have nothing to do with physical fitness.

    Regarding the Letter in The New York Times from 50 Republican “Endless War” Policy Advocates

    Some 50 Republican “foreign policy experts,” self-proclaimed insiders whose insights led the United States into a disastrous and still burning war in Iraq, have recently published a “we believe” letter in The New York Times reviling Donald Trump and deriding him as unsuited to take up the reins of U.S. foreign policy. But who are these experts and what gives them standing to speak so imperiously about the direction of future U.S foreign policy?

    With a few exceptions such as former Governor Tom Ridge of Pennsylvania and my esteemed friend Ambassador John Negroponte, the 50 are largely national security and foreign policy functionaries of the G. W. Bush Administration era now entrenched in academia or elsewhere. They have one thing in common: They are previous practitioners of and current apologists for now discredited foreign policy initiatives the Bush Administration advanced in the Middle East. Obama adopted those Bush initiatives in large measure. But Donald Trump has forcefully questioned and repudiated many of them. Notably, many big names –Henry Kissinger, James Baker, Condoleeza Rice – of the Republican foreign policy establishment are not signers of The Times letter.

    In the military these initiatives were collected together under the catchy phrase “Shock and Awe”; in foreign policy, the model program was styled “Operation Iraqi Freedom” — relabeled by Obama in 2010 as “Operation New Dawn.” But in both the military and foreign policy realms these were misguided efforts based on a false assumption. Together they did unprecedented damage to U.S. interests, contributing in large measure many have concluded to the emergence of ISIS in Iraq and Syria and setting the stage for today’s virulent brand of worldwide radical Islamic terrorism.

    The policies were based on a logical blunder by policymakers late in the 20th century. The theorists concluded that the break-up of the Soviet Union was affording the United States, as the only still existing super-power, a unique opportunity to reshape the world. We could easily impose, for instance, our national will, by overwhelming conventional force if necessary, to transform Middle Eastern despotic states into American-style democracies. But they were wrong. As we came to learn, quick victories over standing armies (“Shock and Awe” or “rapid military dominance”) is not necessarily a road leading to democracy but, rather, can lead to chaos, including unintended consequences such as Muslim civil war, prolonged street fighting, and terrorist warfare. So the vision of creating Middle Eastern democratic states in our image proved unrealistic, a pipe dream overwhelmed by traditional tribal divisions and bloody Shiite, Sunni and other sectarian passions.

    The 50 experts are making an argument to authority. Even if an argument to authority weren’t a classic fallacy, why should any of us (left, right, center) grant this group–whose members steered a policy course that has proved dreadfully costly in lives lost and treasure squandered–any authority to comment or advise us.

    Although I find Donald Trump’s blunt call for reassessment of our priorities long overdue, I can appreciate that there are those who find him off-putting–even when he’s saying things they know are true. The signatories to this hit piece tied themselves in knots explaining that they didn’t propose to talk about policy positions–only fitness and temperament. They protest too much. And they are playing to those who are unsettled by Donald Trump’s outspokenness and departures from the script (and the orthodoxies) the pundits tell us he is supposed to follow.

    By taking their stand, ostensibly on the narrow high ground of temperament, the signatories plant their flag for a candidate whose hot temper (albeit one well-masked in public) and vindictiveness are well-documented. They plant their flag, too, for a candidate who has been disturbingly careless with classified information. And they condone a candidate who is part of a global scale pay-to-play scheme. Entities and individuals whose interests diverge from our nation’s have paid handsomely for access to the Clintons. Surely that should raise some questions about fitness.

    Having led their party and the nation into disastrous foreign policy adventures, the wise experts who presume to teach us about Donald Trump’s mental states, laid the groundwork for their party’s defeats in 2008 and 2012. Now, on grounds of “temperament” they are working to ensure its defeat again.

    Donald Trump won the Republican nomination by arguing (repeatedly) for avoiding overly ambitious military and foreign policy adventures and using American interest as a guiding principle. Notwithstanding his campaign style and (unacknowledged) playful sarcasm in public discourse, his repeatedly stated foreign policy positions represent well-tested ideas and principles. He won an argument in the Republican party and the Brahmins lost. But they deserved to lose. And they don’t deserve to be granted any authority in debates and disputes about what will be prudent for our nation going forward.

    The claims about temperament and suitability (which reflect, among other things, a shameless applicaton of double standards) are cover for policy differences and self-interest. And they are not serious.

    Ambassador Faith Whittlesey served as White House Director of the Office of Public Liaison from 1983 to 1985 and twice, from 1981 to 1983 and again from 1985 to 1988, as U.S. Ambassador to Switzerland. She also was active in President Reagan’s unsuccessful 1976 campaign and was Co-chairman of President Reagan’s Pennsylvania campaign in 1980.

    ‘Iron Nun’ Proves Youth Is Unlimited In Nike Ad

    With a nickname like the “Iron Nun,” Sister Madonna Buder isn’t the kind of lady you’d want to underestimate.

    The 86-year-old appears front and center in Nike’s new ad “Unlimited Youth,” where she runs, bikes, and swims with a resilient ferocity that could outpace many who are half her age.  

    “The Iron Nun” got her moniker from the Ironman, a grueling triathalon race that packs together a 2.4 mile swim, a 112 mile bike, and 26.2 mile run. 

    Buder has done over 40 of these races, proving to her fans that youth has no age limit.  

    The athlete started her running career when she was 47 years old, after listening to a priest talk about the benefits of the sport. She ran her first triathlon in 1982, when she was 52 years old. She became the oldest woman to ever complete an Ironman race at the age of 75. She’s been on the move since then, often pushing races to open up a new age division so she can register to compete. 

    In an interview with Cosmopolitan, Buder said that she manages to fit her training for these races in with her daily life. The sister, who is part of a nontraditional religious order called the Sisters for Christian Community, runs to her church in Spokane, Washington. She also runs to the local jail, where she volunteers to chat with inmates. 

    For her diet, Buder said she likes to focus on eating fruits and vegetables, but doesn’t shy away form carbs and proteins. 

    Much of her passion for the sport comes from the fact that running helps her see more of the world ― she’s traveled internationally for her races ― and the fact that she gets to inspire people to dream big.

    “Don’t pay attention to how old you are, only focus on how old you feel,” she told Cosmopolitan. “And be patient — one of my worst enemies is patience, I’m still trying to fine-tune it so that I’m able to stop and smell the roses.”

    She’s had a few setbacks. She once fractured her pelvis during bike training, and in 2014, she wasn’t able to finish an Ironman race in Kailua-Kona, Hawaii.

    But that doesn’t mean she plans to quit anytime soon. 

    “There are a lot of times when I had to think about failures and not reaching the goals I may have set for myself,” Buder said in a Nike video. “Then I realized the only failure is not to try because your effort in itself is a success.”

    Republicans Got Totally Scammed By Donald Trump’s Creation Myth

    WASHINGTON ― For the past year, Donald Trump has been selling himself to Republican voters and party leaders as a master developer, casino mogul, airline executive and all-around brilliant businessman.

    What they didn’t hear much about, though, was his single greatest talent: master self-promoter.

    Now, with the general election just three months away, they are learning they may have been sold a bill of goods. That Trump was actually a so-so developer. That his casinos failed and pushed him to the edge of personal bankruptcy. That his airline was a money-losing vanity project that he eventually lost when he missed loan payments. That his business acumen, far from brilliant, is now fodder for millions of dollars’ worth of negative TV ads.

    “He is, as someone said, the hobo’s idea of a billionaire,” said Rick Wilson, a Florida political consultant who is now working for independent candidate Evan McMullin. “I’ve had donors say: ‘I’m a billionaire. Trump’s a clown with a credit card.’”

    “Trump is the master of creating a perception that he is successful, when he has used aggressive lawsuits and multiple bankruptcies in attempts to mask huge failures,” said Texas Republican consultant Matt Mackowiak.

    For his part, Trump continues to insist he’s worth more than $ 10 billion, despite outside reviews that calculate his net worth at less than half that. A National Journal analysis of his finances found that he would have been far richer if, when he took control of his father’s empire in 1974, he had instead taken his share and merely put it into a stock market index fund.

    Yet for millions of Republican voters, Trump’s self-proclaimed business savvy and great wealth ― as seen on television for years and validated by party leadership last autumn ― were major reasons for backing him over more than a dozen Republican governors and senators.

    In New Hampshire last June, 67-year-old janitor Steven Sweeney said: “The Donald is going to shake things up. He’s got money. They can’t buy him. They’re not going to be able to push him around.”

    In Des Moines, Iowa, last August, fairgoer after fairgoer dropping corn kernels into Trump’s jar as part of a straw poll said his business experience was what was needed in the White House.

    Now, nomination in hand, Trump’s sway over his hardcore supporters may have only strengthened. One, a barbershop owner in St. Clairsville, Ohio, the site of a recent Trump campaign rally, seemed genuinely distraught at the suggestion that Trump was not as successful as he claimed.

    “Mr. Trump is worth every dollar he says he is,” said the barber, giving only his first name, Kent. “Mr. Trump is a man of his word.”

    Unfortunately for Trump and the Republican Party, the Kents of this country make up only a fraction of the voters Trump will need to win in November. As for the non-Kents ― particularly voters in the half dozen battleground states this year ― they will have been flooded with tens, even hundreds of millions of dollars of advertising using Trump’s business record against him.

    Recent polling by The Huffington Post and YouGov shows that Democrats and independent voters, the groups that Trump must start persuading, are already receptive to that unflattering message.

    While 70 percent of Republicans believe Trump is at least as rich as he says he is, only 44 percent of Democrats and independents believe that. Perhaps even more worrisome for Trump: While 65 percent of Republicans call him “very successful,” only 41 percent of independents and 27 percent of Democrats do so.

    “He’s the master of the long con, pretending to be something he isn’t to scam the next victim,” Wilson said. This time, he added, the victim is the GOP itself.

    Trump businesses tanked, but Trump’s brand soared

    Although Trump may not really be a brilliant businessman, he played one on TV. For over a decade, his primetime series made his success part of the popular culture, bringing him into as many as 28 million living rooms a week. Starring in “The Apprentice” and its follow-up, “The Celebrity Apprentice,” Trump played an authoritative businessman making rational decisions. Never mind that the tasks the contestants had to perform ranged from the menial to the ridiculous. Trump himself, week after week, was the show’s voice of informed reason, making a tough but fair decision at the end of each episode.

    The series itself was created by Mark Burnett, the producer of the “Survivor” reality TV show. He came up with the idea after reading Trump’s book, The Art of the Deal, which portrayed Trump as the shrewd, level-headed builder of a vast and profitable business empire.

    That best seller was the first real vehicle pushing Trump’s celebrity beyond the reach of the New York City tabloids. It’s written in an easy, sometimes self-deprecating style ― which essentially makes it a work of fiction, according to Trump’s ghostwriter.

    Tony Schwartz, who split millions of dollars with Trump from the book’s earnings, came forward last month, saying he had grown alarmed that Trump could actually win the presidency based on the character Schwartz had created.

    “I broke the unspoken code of confidentiality with Donald Trump on Art of the Deal because I truly believe his election imperils the planet,” Schwartz wrote in a July 27 tweet.

    In a New Yorker piece, Schwartz described a man unable to focus for any period of time and driven by a compulsive need for more money and more attention, to the point of reckless behavior.

    If he were writing the book today, he said, it would be called The Sociopath.

    Indeed, within a few years of the book’s 1987 release, Trump’s empire was on the verge of collapse. His casinos in Atlantic City were bleeding money. Trump had personally guaranteed nearly $ 1 billion in business loans, which were now threatening to put him into personal bankruptcy. Over a period of years, Trump’s empire shrank as lenders made him hand over ever-larger portions of his holdings and forced him to give up personal extravagances like his 281-foot-yacht. They even put him on an allowance.

    With his credit shot, Trump’s business model shifted away from building things and consolidated instead around collecting a salary and profits from his television show, membership dues from his golf courses and fees for the use of his name on various hotels and condominiums that he did not own.

    The Trump “brand,” thanks to his aggressive and constant promotion, had become his primary business line.

    None of his defeats made him change the way he presented himself. In every speech, every debate, every interview, Trump brags about his success: his “phenomenal business,” his “tremendous cash flow,” his “very low debt.”

    “I built a phenomenal business with incredible, iconic assets, one of the really, truly great real-estate businesses,” Trump said at last autumn’s Reagan Library debate.

    Republican voters believed him.

    “He’s a great builder,” said retired contractor Frank Savino at Trump’s very first “house party” in New Hampshire last summer. “He means what he says, and he says what he means.” 

    GOP leaders bought the myth, now stuck with it 

    That the average American tended to believe Trump’s boasts heading into last summer is perhaps understandable. After all, that was the proposition underlying his reality TV show for 12 years.

    But what put Republicans into the box that traps them today is the failure of party leaders and Trump’s primary rivals to challenge that premise back when there was still time. During the crucial early debates last year, most of the other candidates ― assuming that Trump’s popularity would fade as the actual voting drew closer ― avoided attacking Trump. Even more important, they acknowledged his business success as a given.

    “I love Donald Trump. He is a good man,” former Arkansas Gov. Mike Huckabee said at the October debate in Boulder, Colorado. “I’m wearing a Trump tie tonight. Get over that one, OK?”

    The party’s top officials, meanwhile, were so fearful of Trump’s purported net worth and a threatened third-party run that chairman Reince Priebus traveled to Trump Tower and secured Trump’s signature on a pledge that he would support the eventual nominee. (Trump repudiated the pledge this spring, citing the party’s unfair treatment of him.)

    While other candidates eventually starting calling Trump a liar and a con man, top Republican officials, advisers and donors continue to this day to believe Trump’s self-portrait of a business genius.

    “He builds buildings. He runs a large business,” Andy Puzder, the CEO of the company that owns the Hardee’s and Carl’s Jr. restaurant chains, told HuffPost recently. “He certainly has all the indications of wealth.”

    Supply-side economist Stephen Moore, one of Trump’s economic advisers, pointed to Trump’s numerous buildings as proof of his success ― seemingly unaware that many had nothing to do with Trump beyond sporting his name on a sign. “One of the things that he is a master at is branding,” he said. “His business skills are unrivaled.”

    A great irony for Republicans is that four years ago they nominated a candidate who actually did have great business skills. For those who believe that running a successful presidential campaign requires a no-nonsense mindset to make informed decisions, Mitt Romney possessed that in spades ― and still lost the popular vote by a significant margin, thanks to demographics that are tilting ever more drastically against Republicans.

    Four years later, with fewer than 90 days left before the election, the party is stuck with Romney’s opposite: an at-best mediocre businessman, with an all-nonsense, all-the-time approach to campaigning based primarily on his whims at any given moment.

    Republican leaders concede privately that it is next to impossible to make Trump accept advice and that even to try risks putting him in a foul mood that makes the effort counterproductive.

    To ghostwriter Schwartz, who followed Trump around for 18 months gathering material for The Art of the Deal, none of this is surprising.

    “Trump doesn’t take advice from anyone. Ever. That won’t change. He is who he is. He won’t reset because he can’t,” Schwartz tweeted on Aug. 3. “Never thought I’d say this: Trump is worse today ― harsher, more erratic, more grandiose ― than when I first met him. And he was bad then.”

    Traveling Playmates And Benefits Of A Road Trip

    A few days ago I posted about partners and how much fun it can be to play with them not only in your home city, but across the globe. There is something about traveling in an intimate space that can really bring you closer in connection with your partner.

    That is one of the reasons why traveling on a road trip can be such a fun excursion. You have the opportunity not only to spend time with them in enjoyable places, but also become physically (and emotionally) close to them in order to further the relationship.

    The Benefits of the Road Trip

    Now that I’ve made it clear how great a road trip can be, it’s time to put my money where my mouth is. What makes it so great? How can you improve the quality of your road trip? Here are a few of my answers.

    1. Road trips test your boundaries – If you go on a road trip with your partner, it isn’t just fun and games. It is going to be work in some respects. You are going to have to learn what you can accept in the relationship and what you do not accept. There will be times where you feel the need for space, but through it all you will really learn how to connect with your partner and see them for what they are.

    Testing your boundaries is the best thing that you can ask for in a relationship. Indeed, it is a great test of your abilities in partnership so that you can determine if you are ready for the next steps.

    2. Road trips are about shared experiences – After a breakup, one of the reasons the city you mutually lived in is so hard to remain is because of everything that reminds you of them. These are the shared experiences. Now consider going across the country or globe with this significant other and all of the different experiences that you will share. It makes a big difference. Just make sure you capture those travel experiences so you don’t end up losing the memories or having them become stale.

    3. Road trips strain financial and adult topics – some relationships are nothing but good feelings and a lesser version of hedonism (think partying, partying, sex, and partying with sex). While that can be fun, a relationship is going to face practical challenges and it is better to look at them sooner than later.

    Go Forth and Travel

    You may never consider traveling with your partner in the same way after you do a road trip together. In fact, you may never see them as humans in the same way. This is one of the reasons why it is so imperative to try something like this. Stretching the bounds of your relationship will ultimately leave you knowing more, connecting deeper, and feeling better about yourself and future together.

    See Grandpa’s Olympic Reaction To Subway Seat Offer During Rio 2016

    Thanks for asking. But no, Wayne McEntire really doesn’t need that seat.

    The 68-year-old grandfather from Amarillo, Texas, showed off his awe-inspiring gymnastic skills after someone kindly offered him a preferred seat for elderly people on the subway in Rio de Janeiro, Brazil.

    Instead of accepting the generous offer, he suspended himself horizontally in the air on a pole in an impressive flag pole lift, ABC News reports.

    His 19-year-old grandson Britton Barker was with him on the train during their Rio visit for the Olympic Games, and he snapped the spectacular stunt. The photos are now going viral.

    Someone offered my grandpa a preferred seat for elderly people on the subway and he did this,” Barker posted to Twitter Thursday alongside a series of images.

    They’d been liked more than 100,000 times and received 77,000 retweets as of Saturday morning. “Oops accidentally made Papa Twitter famous,” Barker later added.

    He told British website indy100 that his grandfather is a regular at his local gym and often pulls off similar sensational stunts for him and his friends.

    His extremely strong upper body and the strength of his core gives him the ability to hold his entire body weight up in a straight position,” Britton said. “He is a one of a kind grandfather, that is for sure!”
